There will always be a need for mortgage financing. It may be in the shape of a refinance boom, a purchase money market, or a yet to be discovered desired mortgage product. Whatever shape or form this financing takes, this is a significant transition for the consumer.
The members of the National Association of Mortgage Professionals and candidates for the Motgage M™ believe that the interests of the public and the mortgage industry are best served through the voluntary observance of NAMP's Gold Standard of Professional Conduct and understand they must adhere to the following:
NAMP GOLD STANDARD OF PROFESSIONAL CONDUCT
CONDUCT AND RESPONSIBILITIES AS A NAMP MEMBER OR NAMP CANDIDATE
Members and Candidates must not engage in any conduct that compromises the reputation or integrity of the National Association of Mortgage Professionals, NAMP, the Mortgage M™, M ADVOCATE™, or M PRO™ designation or the integrity, validity, or security of NAMP.
CONFLICTS OF INTEREST
Members and Candidates must make full and fair disclosure of all matters that could reasonably be expected to impair their independence and objectivity or interfere with respective duties to their clients, prospective clients, and employer. Members and Candidates must ensure that such disclosures are prominent, are delivered in plain language, and communicate the relevant information as required by state and/or federal law, effectively.
FAIR LENDING
Members and Candidates must deal fairly and objectively with all clients when providing mortgage financing analysis and recommendations.
KNOWLEDGE OF THE LAW
Members and Candidates must understand and comply with all applicable state and federal laws, rules, and regulations (including NAMP's Gold Standards of Professional Conduct) of any government, regulatory organization, or licensing agency. In the event of conflict, Members and Candidates must comply with the more strict law, rule, or regulation. Members and Candidates must not knowingly participate or assist in and must separate themselves from any violation of such laws, rules, or regulations.
LOYALTY TO THE MORTGAGE INDUSTRY
In matters related to employment in the mortgage industry, Members and Candidates must act for the benefit of the mortgage industry and not bring discredit to our profession. Members and Candidates must not engage in any conduct that compromises the reputation or integrity of the mortgage industry.
MIS-REPRESENTATION
Members and Candidates must not knowingly make any misrepresentations or distort the mortgage application in anyway with the intent to mislead mortgage financing analysis and recommendations to prospective and current client and to mortgage industry members.
PRESENTATION AND DISCLOSURE
When communicating mortgage financing terms, fees and conditions, Members or Candidates must make every reasonable effort to ensure that it is fair, accurate, and complete and abides by all legal requirement of disclosure. Distinguish between fact and opinion in the presentation of mortgage financing, analysis, and recommendations.
PROFESSIONALISM
Act with integrity, competence, diligence, respect, and in an ethical manner with the public, prospective and current clients, employers, employees, and colleagues in the mortgage industry.
Place the interests of your prospective and current clients and the integrity of the mortgage profession above your own personal interests.
Use reasonable care and exercise independent professional judgment when conducting mortgage analysis and recommendations.
Practice and encourage others to practice in a professional and ethical manner that will reflect credit on themselves and the mortgage profession.
Maintain and improve your professional competence and strive to maintain and improve the competence of other mortgage professionals.
PRUDENCE AND CARE
Members and Candidates have a duty to their prospective and currents clients and must act with reasonable care and exercise prudent judgment. Members and Candidates must act for the benefit of their clients and place their clients' interests before their employer's or their own interests. In relationships with clients, Members and Candidates must determine applicable fiduciary duty and must comply with such duty to persons and interests to whom it is owed.
SUITABILITY
When Members and Candidates are in an advisory relationship with a client, they must make a reasonable inquiry into a prospective or current client mortgage financing experience prior to making any mortgage financing recommendation. At all times judging the suitability of mortgage program in the context of the client's need and abilities.
REFERENCE TO NAMP, THE MPRO™ DESIGNATION AND THE MORTGAGE M™
When referring to NAMP, NAMP membership, the MPRO™ designation, or candidacy in NAMP, Members and Candidates must not misrepresent or exaggerate the meaning or implications of membership in NAMP, or holding the Mortgage M™. |
